Wills and Estates Solicitors Clarkston, Giffnock

  • The Law Society of Scotland
UKRAINE HUMANITARIAN APPEAL

A Will gives you peace of mind that your personal possessions and assets will be distributed exactly the way you wish. On the other hand, if you don’t have a Will, the law will determine how your estate will be wound up after you pass away – this is known as intestacy. This means your property may not be dealt with how you would have wanted, and your loved ones will have a far more complex situation to deal with.

If you plan to write a Will, you should get legal advice so you can be sure the document is properly drafted and valid. Solicitors will also ensure your Will covers all the necessary instructions, such as how essential payments – including inheritance tax and funeral bills – should be made and what to do if a beneficiary dies before your estate is wound up. People who draft wills themselves often leave out these important directions.

Wills Lawyers Clarkston, Newton Mearns, Giffnock, Netherlee, Eaglesham, Carmunnock, Stewarton, Southside Glasgow

Our highly-experienced team have helped many clients in Clarkston, Newton Mearns, Netherlee, Giffnock, East Kilbride and the greater Glasgow area create effective and binding wills. Don’t hesitate to get in touch if you’d like to discuss your situation.

The contents of your Will

Your Will can include instructions on several issues, the main being:

  • Who you wish to manage your estate (the Executors);
  • Who your possessions and assets should be given to (the Beneficiaries);
  • How your children under 16 should be cared for; and
  • Arrangements for your funeral.

We will also ensure that any religious wishes and requirements are mentioned in the Will.

The legal requirements

For your Will to be legally binding, it must comply with several rules. For example, it must be in writing, signed by you on each page, and in order to be valid, it must be signed in the presence of a witness. We’ll make sure that all the legal requirements are met so that there’s nothing to prevent your Will from taking effect.

Creating your Will

It’s important to have your Will professionally prepared. Law books are full of reported cases arising from homemade or badly-drafted Wills. It’s easy to make mistakes, but these errors can cause big – and sometimes expensive – problems for your Executors.

When you instruct Claphams, we’ll listen carefully to your intentions. We’ll then create a draft Will that reflects your wishes and give it to you for review. Once you’re happy with the contents, we’ll arrange for the will to be signed and if necessary witnessed. Finally, we’ll hold the document in safe custody without charge.

To start creating or updating your will, please complete our will form today, and a member of our team will be in touch to complete the process.

Updating your will

Inevitably, circumstances in your life will change. For instance, you may buy another property, you may get divorced, or you may have children. Your Will can easily be amended to take account of any significant changes to your situation. We can review your Will, advise on amendments, and ensure any updates you wish to make are legally binding.
