Scottish Standard Clauses – Do They Still Add Value?

In a recent article published in The Journal of the Law Society of Scotland, Debra Clapham, partner at Claphams Solicitors, gives an interesting insight into the use of Scottish Standard Clauses in the Scottish house sale and purchase process.

The article gives a brief history of attempts to standardise missives in Scotland, which eventually led to the creation of the second, and current, edition of the Scottish Standard Clauses in May 2015.

Debra questions the value these clauses bring to the house buying process, highlighting that in reality lawyers will often add qualifications or additions to these clauses to varying degrees.
